Welcome to AutoFinder.je. These Terms and Conditions ("Terms") govern your use of the AutoFinder.je website (the "Website"), which is owned and operated by Granite Digital ("we", "us", or "our").

Please read these Terms carefully before using our services. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Website.

1. The Service

1.1. The Website is an online platform that lists new and used vehicles for sale and acts as a venue to allow users who wish to sell a vehicle ("Sellers") to connect with users who wish to purchase a vehicle ("Buyers"). The platform serves both individual sellers and registered car dealerships.

1.2. Important Disclaimer: The role of the Website is strictly limited to facilitating communication between Buyers and Sellers. We are not a vehicle dealer, auctioneer, broker, or a party to any transaction or agreement made between a Buyer and a Seller. We do not buy, sell, or take ownership of any vehicle listed on the Website.

1.3. Dealership Services: Registered car dealerships may create business accounts to list their vehicles. We may offer additional services to dealerships, including but not limited to automated listing services, subject to separate written agreements and explicit written consent from the dealership.

2. User Obligations

2.1. To use certain features of the Website (such as creating a listing or contacting sellers), you will be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.

2.2. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your account password.

2.3. You agree not to use the Website for any unlawful purpose or to post any information that is false, misleading, fraudulent, defamatory, or infringes on the rights of any third party.

2A. Dealership Accounts and Services

2A.1. Business Registration: Car dealerships may register for business accounts by providing accurate business information, including but not limited to business name, registration number, contact details, and authorized representatives.

2A.2. Dealership Verification: We reserve the right to verify dealership credentials and may require additional documentation to confirm business status.

2A.3. Automated Listing Services: We may offer automated services to dealerships, including but not limited to web scraping services to import vehicle listings from dealership websites, which require explicit written consent from the dealership.

2A.4. Data Responsibility: Dealerships are solely responsible for ensuring they have the legal right to allow scraping of their website data and that such scraping complies with their own website terms and applicable laws.

2A.5. Service Limitations: We make no guarantees about the accuracy, completeness, or timeliness of data obtained through automated services. Dealerships remain responsible for verifying all imported data.

2B. Prohibited Uses

2B.1. You agree not to use the Website for any of the following prohibited activities:

3. Vehicle Listings

3.1. Sellers are solely responsible for the accuracy, content, and legality of their listings, including but not limited to the vehicle's description, condition, price, and photographs.

3.2. We do not verify, endorse, or guarantee any listing or the information provided by any user.

3.3. We reserve the right, in our sole discretion, to refuse any listing that we believe is inappropriate or violates these Terms.

3.4. Right to Remove Content. We reserve the right, in our sole discretion and without prior notice, to remove any listing or content that we believe: a) Is in violation of these Terms; b) Contains false, fraudulent, misleading, or deceptive information; c) Pertains to a vehicle that has been reported as stolen, has had its Vehicle Identification Number (VIN) altered, or is otherwise illegal to sell; or d) May expose Granite Digital, our users, or the public to harm or liability. We are under no obligation to investigate any claim or suspicion but may do so at our discretion.

3.5. Listing Status Management. When you pause or deactivate a listing, it will remain in this state for 60 days. After this period, the listing will automatically be moved to the sold/unsold section in your account. This same logic will apply to paid subscription listings when fees are introduced. You may reactivate a paused or deactivated listing at any time before the 60-day period expires.

3A. Content Moderation and Disputes

3A.1. If you believe that any content on the Website violates these Terms or is otherwise inappropriate, you may report it by emailing us at info@autofinder.je.

3A.2. We will review reported content and take appropriate action, which may include removing the content, warning the user, or suspending/terminating their account.

3A.3. If you disagree with any moderation decision, you may appeal by contacting us at info@autofinder.je. We will review appeals in good faith, but our decision is final.

4. Payment Terms

4.1. Current Service: At the time of these Terms, the Website is provided free of charge to all users. There are currently no fees for creating listings, browsing vehicles, or using the basic features of the Website.

4.2. Future Fee Introduction: We reserve the right to introduce fees for certain services or features in the future. Any new fees will apply only to new listings created after the fee introduction date.

4.3. Grandfathering: Existing listings created before any fee introduction will remain free for their duration, unless otherwise specified in the fee announcement.

4.4. Fee Changes: We reserve the right to modify, increase, or decrease any fees at any time. Users will be notified of fee changes through the Website (including banner notifications, pop-up alerts, or updated pricing pages) at least 14 calendar days in advance.

4.5. Payment Methods: If fees are introduced, acceptable payment methods will be specified at the time of implementation. All fees will be clearly displayed before any payment is required.

5. Disclaimers and Limitation of Liability

5.1. No Responsibility for Transactions. As the Website is a neutral venue, we have no control over and do not guarantee: * The existence, quality, safety, or legality of vehicles advertised; * The truth or accuracy of users' content or listings; * The ability of Sellers to sell vehicles; * The ability of Buyers to pay for vehicles; or * That a Buyer or Seller will actually complete a transaction.

5.2. Verification is the User's Responsibility. It is the sole responsibility of the Buyer and Seller to verify all legal and factual aspects of a potential transaction. This includes, but is not limited to: * Verifying the vehicle's ownership, history, condition, and registration status. * Ensuring all legal paperwork is correct and complete. * Arranging for secure payment and transfer of ownership.

5.3. No Financial Responsibility. We are not involved in the financial transaction between the Buyer and Seller. We take no responsibility for any financial loss, damages, disputes, or other implications arising from any transaction or communication facilitated by the Website. Any dispute is solely between the Buyer and the Seller.

5.4. "AS IS" Service. You agree that your use of the Website is at your sole risk. The Website and its services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied.

5.5. Limitation of Liability. To the fullest extent permitted by Jersey law, Granite Digital, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, or other intangible losses, resulting from the use or the inability to use the service.

5.6. Web Scraping Services Liability. For any automated services, including web scraping services provided to dealerships, Granite Digital shall not be liable for: a) Any legal issues arising from the scraping of third-party websites; b) Accuracy, completeness, or timeliness of scraped data; c) Any violations of the dealership's website terms of service or applicable laws; d) Any damages resulting from the use of scraped data. Dealerships assume full responsibility for ensuring legal compliance and data accuracy.

6. Data Protection and Privacy

6.1. Your privacy is important to us. By using our Website, you agree to the collection and use of your personal data in accordance with our Privacy Policy.

6.2. Our Privacy Policy explains what personal data we collect (including name, email address, phone number, and vehicle data), how we use it, how long we store it, and your rights under the Data Protection (Jersey) Law 2018. Please review it carefully.

6.3. Anonymized Data Usage: We may collect, process, and use anonymized and aggregated data from vehicle listings and sales transactions for the following purposes:

This anonymized data usage does not include any personal information that could identify individual users, sellers, or buyers, and is conducted in compliance with applicable data protection laws.

7. Intellectual Property

7.1. All content on the Website, including text, graphics, logos, and software, is the property of Granite Digital or its content suppliers and is protected by copyright and other intellectual property laws.

7.2. By creating a listing, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, and display the content of your listing in connection with the Website and our promotional activities.

8. Termination

8.1. We may, in our sole discretion, suspend or terminate your account and access to the Website if you violate these Terms or for any other reason without notice.

9. Governing Law and Jurisdiction

9.1. These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Jersey, Channel Islands.

9.2. You irrevocably agree that the courts of Jersey shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.

10. Severability

10.1. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

10.2. If any invalid, illegal, or unenforceable provision would be valid, legal, or enforceable if part of it were deleted, that part shall be deemed deleted, and the rest of the provision shall remain in effect.

11. General

11.1. These Terms constitute the entire agreement between you and Granite Digital regarding your use of the Website and supersede all prior and contemporaneous agreements, representations, and understandings.

11.2. We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Website and updating the "Last Updated" date. Your continued use of the Website after such changes constitutes your acceptance of the new Terms.
