Welcome to AutoFinder.je. These Terms and Conditions (the "Terms") govern your use of the AutoFinder.je website (the "Website"), which is owned and operated by Granite Digital ("we", "us", or "our"), a business registered in Jersey, company number 36294.
Please read these Terms carefully before using our services. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Website.
1. Definitions
In these Terms:
- "Buyer" means a User who uses the Website to find or enquire about vehicles for purchase.
- "Consumer" means an individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.
- "Content" means any information, text, images, photographs, video, data, or other material posted, uploaded, or transmitted to the Website by a User.
- "Dealership" means a registered motor trader holding a business account with us.
- "Listing" means an advertisement posted on the Website offering a vehicle for sale.
- "Seller" means a User who posts a Listing or otherwise uses the Website to advertise a vehicle for sale.
- "User", "you", or "your" means any person who accesses or uses the Website, whether or not registered.
2. Eligibility and Accounts
2.1 Age requirement
You must be at least 17 years old to create an account, post a Listing, or enter into any transaction facilitated by the Website. By using the Website you confirm that you are 17 or over and have the legal capacity to enter into a binding agreement.
2.2 Account registration
To use certain features (such as creating a Listing or contacting Sellers), you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.
2.3 Account security
You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your password. You must notify us immediately at info@autofinder.je if you suspect any unauthorised use of your account.
2.4 One account per User
Unless otherwise agreed in writing, each User may hold only one personal account. Dealerships may hold one business account per legal entity.
3. The Service
3.1 What we provide
The Website is an online platform that lists new and used vehicles for sale and acts as a venue for Sellers to connect with Buyers. The platform serves both individual sellers and registered car Dealerships.
3.2 Venue only
The role of the Website is strictly limited to facilitating communication between Buyers and Sellers. We are not a vehicle dealer, auctioneer, broker, agent, or party to any transaction or agreement made between a Buyer and a Seller. We do not buy, sell, take possession of, or take ownership of any vehicle listed on the Website. Any contract for the sale of a vehicle is formed exclusively between the Buyer and the Seller.
3.3 No vetting
We do not vet, verify, endorse, or guarantee any User, Listing, vehicle, or information posted on the Website. Any inspections, valuations, ownership checks, history checks, finance checks, payment arrangements, and transfer of title are the sole responsibility of the Buyer and Seller.
4. User Obligations and Prohibited Uses
4.1 General obligations
You agree to use the Website lawfully and in accordance with these Terms. You will not use the Website to post or transmit any Content that is false, misleading, fraudulent, defamatory, obscene, threatening, harassing, or that infringes the rights of any third party.
4.2 Prohibited uses
You agree not to:
- Create multiple accounts to circumvent restrictions, suspensions, or fees
- Use automated systems, bots, scrapers, or scripts to post Content, harvest data, or interact with the Website (except where we have given express written consent)
- Send spam, unsolicited communications, marketing material, chain messages, or any form of harassment to other Users
- Attempt to circumvent any fees, restrictions, or limitations imposed by these Terms
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Website or any underlying software
- Interfere with, disrupt, or place an unreasonable load on the Website's functionality, security, or infrastructure
- Use the Website to advertise goods or services other than vehicles legitimately offered for sale
- Misrepresent yourself, your relationship with any vehicle, or the vehicle itself
- Use the Website in connection with any vehicle that you know or reasonably ought to know is stolen, has had its Vehicle Identification Number (VIN) altered, is subject to outstanding finance not disclosed to the Buyer, or is otherwise illegal to sell
4.3 Anti-scraping
You may not scrape, harvest, index, copy, or otherwise systematically extract data from the Website, whether manually or by automated means, without our prior written consent. This restriction applies to all third parties as well as Users.
5. Vehicle Listings
5.1 Seller responsibility
Sellers are solely responsible for the accuracy, content, and legality of their Listings, including the vehicle's description, condition, mileage, history, price, photographs, and any representations made in communications with prospective Buyers.
5.2 No verification or endorsement
We do not verify, endorse, or guarantee any Listing or the information provided by any User. Buyers should carry out their own due diligence before entering into any transaction.
5.3 Right to refuse or remove
We reserve the right, in our sole discretion, to refuse, edit, or remove any Listing or Content that we believe:
- Violates these Terms
- Contains false, fraudulent, misleading, or deceptive information
- Pertains to a vehicle reported as stolen, with an altered VIN, or that is otherwise illegal to sell
- Infringes any third-party rights
- May expose Granite Digital, our Users, or the public to harm, liability, or reputational damage
5.4 Listing status
When you pause or deactivate a Listing, it remains in that state for 60 days. After this period it automatically moves to the sold or unsold section in your account. You may reactivate a paused or deactivated Listing at any time before the 60-day period expires.
6. Dealership Accounts and Services
6.1 Dealership registration
Dealerships may register for business accounts by providing accurate business information including business name, registration number, contact details, and authorised representatives. You warrant that the persons registering and acting on behalf of the Dealership have authority to bind the Dealership to these Terms.
6.2 Verification
We reserve the right to verify Dealership credentials and may require additional documentation, including evidence of trading status and any required regulatory registrations or licences.
6.3 Dealership consumer obligations
Where a Dealership sells to a Consumer, the Dealership is solely responsible for compliance with all applicable consumer protection legislation, including but not limited to the Supply of Goods and Services (Jersey) Law 2009. The Website is not a party to such transactions and accepts no responsibility for the Dealership's compliance.
6.4 Automated listing services
We may offer automated services to Dealerships, including services that import vehicle Listings from the Dealership's own website or systems. These services are provided subject to a separate written agreement and explicit written consent from the Dealership.
6.5 Dealership warranties for automated services
Where a Dealership requests automated import or scraping services, the Dealership warrants and represents that:
- It owns or has the right to grant us a licence to use all data, images, and Content imported
- The imported Content does not infringe any third-party rights, including copyright, database rights, trade marks, or privacy rights
- It has obtained all necessary consents (including data protection consents) for the import and use of any personal data contained in the imported Content
- The import complies with the terms of any third-party platforms or services from which data is drawn
6.6 Dealership indemnity
The Dealership agrees to indemnify and hold harmless Granite Digital from and against any claims, losses, damages, fines, and costs (including reasonable legal fees) arising from any breach of the warranties in clause 6.5 or from any Content imported under clause 6.4.
6.7 No guarantee of accuracy
We make no guarantees about the accuracy, completeness, timeliness, or availability of data obtained through automated services. Dealerships remain solely responsible for verifying all imported data and for the accuracy of resulting Listings.
7. Content Moderation and Disputes
7.1 Reporting Content
If you believe Content on the Website violates these Terms or is otherwise inappropriate, please report it by emailing info@autofinder.je with as much detail as possible.
7.2 Our response
We will review reported Content and take action we consider appropriate, which may include removing the Content, issuing a warning, suspending the account, or terminating the account.
7.3 Appeals
You may appeal moderation decisions by contacting us at info@autofinder.je within 14 days of the decision. We will review appeals in good faith. Our decision following appeal is final.
8. Fees and Payment
8.1 Free service
The Website is currently provided free of charge to all Users. There are no fees for creating Listings, browsing vehicles, or using the basic features of the Website.
8.2 Introduction of fees
We reserve the right to introduce fees for certain services or features in the future. Any new fees will apply only to Listings created after the fee introduction date.
8.3 Existing Listings
Listings created before any fee introduction will remain free for their original duration unless otherwise specified in the fee announcement.
8.4 Fee changes
We reserve the right to modify, increase, or decrease any fees at any time. Users will be notified of fee changes through the Website at least 14 calendar days in advance.
8.5 Tax
All fees are stated exclusive of any applicable taxes, including Jersey Goods and Services Tax (GST), unless otherwise stated. Where applicable, tax will be added at the prevailing rate.
9. Intellectual Property
9.1 Our content
All content on the Website not posted by Users (including the AutoFinder.je name and logo, text, graphics, design, software, and underlying code) is the property of Granite Digital or its licensors and is protected by copyright, database rights, trade mark rights, and other intellectual property laws.
9.2 Licence to use the Website
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for its intended purposes, subject to these Terms.
9.3 Licence in User Content
By posting Content (including a Listing) on the Website, you grant Granite Digital a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, adapt, modify (only to the extent necessary for formatting and display), publish, and display that Content for the purposes of:
- Operating, promoting, and improving the Website and our services
- Marketing the Website and its Listings, including in advertising, search engine results, and on social media platforms
- Complying with legal obligations and enforcing these Terms
This licence continues for as long as the Content remains on the Website and for a reasonable additional period for backup, audit, and dispute resolution purposes. It terminates when the Content is permanently deleted from our active systems, save that we may continue to use anonymised and aggregated data as set out in clause 11.3.
9.4 Your warranties on Content
You warrant that you own or have all necessary rights to grant the licence in clause 9.3, and that the Content does not infringe any third-party rights.
10. Termination
10.1 Termination for breach
We may suspend or terminate your account and access to the Website immediately, without notice, if you breach these Terms, if we believe your conduct may cause harm to other Users or to us, or if required by law.
10.2 Termination for convenience by us
We may terminate your account or discontinue the Website (or any part of it) for any reason by giving you at least 30 days' written notice by email to your registered address.
10.3 Termination by you
You may terminate your account at any time by following the account closure process in your account settings or by contacting us at info@autofinder.je.
10.4 Effect of termination
On termination:
- Your right to access and use the Website ends immediately
- We may remove your Listings and other Content from public display
- Provisions which by their nature should survive termination (including clauses 9, 11, 12, 14, and 15) will continue in force
- The handling of your personal data following termination is governed by our Privacy Policy
11. Data Protection and Privacy
11.1 Privacy Policy
Your privacy is important to us. Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms.
11.2 Data protection law
We comply with the Data Protection (Jersey) Law 2018 in our handling of personal data.
11.3 Aggregated and anonymised data
We may collect, process, and use anonymised and aggregated data derived from Listings, sales, and Website usage for market analysis, statistical reporting, service optimisation, and industry insights. Such data does not identify any individual and may be retained and used indefinitely.
12. Disclaimers and Limitation of Liability
12.1 No responsibility for transactions
As the Website is a neutral venue, we have no control over and do not guarantee:
- The existence, quality, safety, condition, mileage, history, or legality of vehicles advertised
- The truth or accuracy of any Listing or User Content
- The identity, solvency, or good faith of any User
- The ability of Sellers to sell or transfer good title
- The ability of Buyers to pay
- That any transaction will be completed
12.2 Buyer and Seller responsibility
It is the sole responsibility of the Buyer and Seller to verify all legal and factual aspects of a potential transaction, including ownership, registration, history, condition, paperwork, finance status, insurance, and payment arrangements.
12.3 No financial involvement
We are not involved in any financial transaction between Buyer and Seller. We accept no responsibility for any financial loss, damage, dispute, fraud, or other consequence arising from any transaction or communication facilitated by the Website.
12.4 Website provided "as is"
Your use of the Website is at your sole risk. The Website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we expressly disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
12.5 Limitation of liability
To the fullest extent permitted by Jersey law, Granite Digital, its officers, directors, employees, contractors, and agents shall not be liable to you for any:
- Loss of profit, revenue, business, or anticipated savings
- Loss of goodwill or reputation
- Loss of data or information
- Indirect, consequential, special, or exemplary loss
- Loss arising from transactions between Users
Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Website, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the greater of (a) £100, or (b) the total amount you have paid us in the twelve months immediately preceding the event giving rise to the claim.
12.6 Liability that cannot be excluded
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability which cannot lawfully be excluded or limited under Jersey law
12.7 Consumer rights
If you are a Consumer, nothing in these Terms affects your statutory rights that cannot be waived or limited by agreement.
13. Indemnity
You agree to indemnify, defend, and hold harmless Granite Digital, its officers, directors, employees, and agents from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your breach of these Terms
- Your Content, including any Listing
- Your use or misuse of the Website
- Any transaction or communication between you and another User
- Your violation of any law or the rights of any third party
This clause survives termination of your account.
14. Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, pandemic, fire, flood, storm, power failure, internet or telecommunications outage, third-party service failure, or industrial action.
15. General
15.1 Entire agreement
These Terms, together with our Privacy Policy and any other policies referenced in them, constitute the entire agreement between you and Granite Digital relating to the Website and supersede any prior agreements or understandings.
15.2 Changes to these Terms
We reserve the right to modify these Terms at any time. Changes will be posted on the Website with an updated "Last Updated" date. For material changes, we will give you reasonable advance notice by email or by a prominent notice on the Website. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
15.3 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, shall be severed. The remaining provisions shall remain in full force and effect.
15.4 No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing to be effective.
15.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to any successor or affiliate without your consent.
15.6 No third-party rights
Except as expressly stated in these Terms, nothing in them confers any right or benefit on any third party under the Contracts (Rights of Third Parties) (Jersey) Law 2002.
15.7 Notices
Any legal notice to us under these Terms must be sent by email to info@autofinder.je. We will give notices to you by email to the address registered to your account or by posting on the Website.
15.8 Relationship of the parties
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Granite Digital.
16. Governing Law and Jurisdiction
16.1 Governing law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Jersey, Channel Islands.
16.2 Jurisdiction
The courts of Jersey shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, save that nothing in this clause prevents us from bringing proceedings to protect our intellectual property rights in any jurisdiction.
16.3 Informal resolution
Before commencing court proceedings, we encourage you to contact us at info@autofinder.je to attempt to resolve any dispute informally. We will respond within 30 days. This clause does not affect your right to commence proceedings at any time.
